[에너지신문] 02 May 2016 - The European Commission announced it is referring Poland to the European Court of Justice for failing to comply with EU environment law when exploring for shale gas. Poland only requires impact assessments for drilling to a depth of more than 5,000m, while the EU rules require assessing the risks to water, air quality and biodiversity when drilling to a depth of more than 1,000m in the shale and mining sector. The high threshold introduced under Polish law does not take into account all relevant criteria and standards established by the Environmental Impact Assessment Directive (Directive 2011/92/EU), which should be used when determining whether certain types of projects require an assessment.
